Content Removed



I regretably removed content from my site today.
I say this because I believe that my archives should not be removed. Sometimes I read them and go, what was I thinking? Actually, there are things I would love to remove.
Anyway:
I received a letter from the lawyer of Joey Hansen which the lawyer copyrighted so I cannot republish it here. Basically, the lawyer took the position that I would be libel along with Global News for Global’s coverage of the DSU issue if Mr. Hansen wins his case against Global News.
This due to my republication (by way of displaying them on my site from a third-party host) of the Global reports on my site therefore rebroadcasting the libel if it is found to be libel.
Therefore, I have removed the display of them from my site to protect myself.
I do not know who uploaded them and have no control over the fact they are out on the internet.
I am not intenting to shy away from journalistic coverage of this issue. The allegations made by the forsenic audit at DSU are very serious in nature and are presently before the courts.
I will cover the court case as best I can from Ontario.
I am watching for any further reports on the New Westminister Police investigation into the DSU situation as well.
I am not shying away from coverage of this issue, I will report as best I can.
I do not know what the outcome of all of this will be. I look forward to reporting Mr. Hansen side of the case and am very interested in what is said. This is a major news story and will have a national effect for students unions.
Canadian Law on internet journalism is not clear at the present time. I cannot afford to fight a suit and still pay for school. My priority is school, this is why I have removed the content from being viewed directly on my site.
I also have been informed of a possible reason why there is vemon between The Other Press and The Peak. It seems that a former editor of The Other Press is now at The Peak.

    – This sounds like BS to me. Can you really copyright correspondance of this kind? If so, can it be confirmed that someone has done so, e.g., by checking with the patent/copyright office?

  2. Even if the lawyer copyrighted it (which should be impossible) you should be able to quote relevant sections. It’s called fair dealing.
    PS – the DSU was put into receivership, but the receiver is Marnie Jensen, a wonderful CFS hack from University of Victoria.

  3. How can he afford to sue all these people and organizations?
    He mentioned in his “Open letter..” printed in the Other Press, the list of people and businesses he was suing. How does he afford the cost? And how could he honestly think that he could win a case against an individual who has a long history of forensic accounting experience. He lied to the college board when he signed the letters that were presented to them stating that the DSU was “in compliance” with the legislation, and he knew that he hadn’t reconciled a bank statement in years!
    Sorry to see a voice silenced….but we know it’s only temporary!

  4. I am working alot right now. Combined with school, I have not been able to find as much time for my blog recently. I am trying to figure out what is occuring at NUSU. If the case is heard in Toronto, I will be in attendance to report the story. I will also file for the court records / submissions on the case.

    Were the Global news videos hosted on YouTube? If so you can’t be held responsible for it. YouTube’s policy clearly states that anyone is allowed to use the youtube videos on their website and rebroadcast/publish the videos (share them on their website). It is the duty of the content OWNER (global news or whomever) to tell YouTube to take down the content, by which the video becomes deactivated from your website. You, however, were completely within your rights. You did not upload the video, host the video, etc, etc.
    Seems like a pretty stupid legal move to try and sue you for using a remotely hosted video that wasn’t yours in the first place.

  6. You do realise don’t you, that McMaster has been filing libel suits against those who would conduct research into activities that may include McMaster’s students and staff. For a research institution to file a [multi-million dollar] lawsuit against fellow academics, to prevent research…..is absolutely without precedent. (Google “Dr.Paul Williams)
    “It’s called fair dealing.”
    Unfortunately, McMaster does not view Canadian law that way (They seem to believe that Egyptian statutes have followed their staff as they moved to Hamiliton)….They have threatened a Toronto newspaper with litigation for reporting on previously written articles in Middle-Eastern newspapers, Blogs, and Internet boards.
